These terms form a binding agreement between you and Emmanuel Kuuku VIganie-Valentine (trading as "SurveyorAI Africa", "we", "us", "our"), the provider of the SurveyorAI Africa platform (the "Service").
By creating an account or otherwise using the Service, you agree to these terms. If you do not agree, you must not use the Service. If you use the Service on behalf of an organization, you confirm you are authorised to bind that organization.
The Service provides coordinate conversion, COGO, traverse adjustment, GIS visualisation, an AI assistant, and related surveying tools. Functionality may evolve over time.
You must provide accurate registration information, keep credentials confidential, and are responsible for activity under your account.
You must not misuse the Service. In particular you must not: (a) use it unlawfully or fraudulently; (b) infringe intellectual property rights; (c) send spam or malware; (d) probe, scan or attempt to breach security; (e) scrape, reverse engineer, or circumvent technical limits; or (f) resell or redistribute the Service without our written consent.
We retain all right, title and interest in and to the Service, including all software, content, documentation and branding. You retain ownership of data and content you upload; you grant us a limited licence to host and process it solely to provide the Service.
Paid plans are billed in advance on a recurring basis at the price displayed at checkout. Subscriptions renew automatically until cancelled. Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms, available at paddle.com/legal/checkout-buyer-terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties.
The AI assistant may produce inaccurate or incomplete output. You are responsible for verifying results before relying on them for professional, regulatory or safety-critical decisions. You must not use the AI features to generate illegal content, infringing material, or content prohibited by our acceptable-use rules.
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or in connection with the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special or exemplary damages, including loss of profits, data or goodwill. Nothing in these terms excludes liability that cannot be excluded by law.
We may suspend or terminate your access for: (a) material breach of these terms; (b) non-payment; (c) suspected fraud or security risk; or (d) repeated or serious violations of our acceptable-use rules. You may stop using the Service at any time by cancelling your subscription and closing your account.
We may update these terms from time to time. Material changes will be notified in-app or by email. Continued use after the changes take effect constitutes acceptance.
These terms are governed by the laws of the seller's place of residence, without regard to conflict-of-laws principles. Disputes will be resolved by the competent courts of that jurisdiction.
